1 - GENERAL CONDITIONS

These General Conditions govern the use of the website www.fitben.com, owned by FITBEN.

This document establishes the conditions that regulate the use of this website and the purchase of products on it. Please read the conditions carefully before using this website. By using this website or ordering through it, you agree to comply with these conditions, so if you do not agree with all the conditions you should not use our website. These conditions can be changed at any time. It is your responsibility to read them regularly, since the conditions existing at the time of using the site or those at the time of the contract, will apply.

FITBEN advises the user to carefully read the general conditions as well as other laws provided on the website and especially any conditions or terms related to the content, as well as the 'Privacy Policy'.

Definitions

- USER: Anyone who accesses the site, even without making any purchase, and who uses, accesses, or disposes of the contents therein.

- CONTENT: All information, texts, links, software, equipment, tools (including photos of Products and Services Offered), etc., which are available and accessed only online through the website and when browsing it.

- REGISTERED USER: any USER who registers on the site, fills in the registration form and can access the private area of users provided on the site.

- LAW: All general and particular conditions placed on the website, and in addition to any legislation that is applicable to it.

- SPAM: It is defined for the purposes of these terms and conditions, as the indiscriminate sending of messages to email accounts without prior authorization from the email holders.

  • This site is intended for general use, so passwords are personal and non-transferable. We also mention that access to it is temporary, allowing us the right to withdraw partial or total access at any time.

All intellectual property rights in software and content available through this website are owned by FITBEN and are licensed and protected by law. All of these rights are reserved by FITBEN. You can save, print or display the contents of this site for your personal use only.

FITBEN undertakes not to make this information available to third parties without your prior authorization, unless it is necessary to process your form, satisfy your request or manage interactive user programs. The user also grants FITBEN the right to exchange any information provided by him, between companies that maintain protocols with FITBEN, for the purposes mentioned above.

It is not allowed to publish, manipulate, distribute or reproduce, in any format, any content on this site, nor the connection of it to any business or company.

3 - SHIPPING AND DELIVERY

FITBEN sends orders to mainland Portugal. The stipulated delivery time for mainland Portugal is 48 hours. The carriers with which we have protocols deliver from Monday to Friday, between 8 am and 6 pm at the address you wish.

Delivery times are indicative and, therefore, are considered valid when there are no physical or structural impediments (for example: incorrect addresses, overdue charges or force majeure setbacks).

Carriers do not deliver on holidays and weekends and it is not possible to choose a specific delivery time.

When your order is shipped, and if you have given us your email, you will receive a code so that you can locate your order on the website of the carrier we use. If you have difficulty locating your order, please contact Customer Support.

Shipping costs:
All shipping costs are free, except reshipments.

Difficulty in delivering:
If the carrier is unable to deliver the order, it will try again the next day or contact you to schedule a new delivery.

Resending returned orders:
When an order is returned to FITBEN under the responsibility of the customer and the customer wants to reship it, or send a new one, a fee of € 5.00 + VAT is required, so that we can process the new order. This fee must be paid by bank transfer and proof of payment sent to our Customer Service, together with the returned order number and the name of the first account holder from which the bank transfer was made.

4 - PAYMENT METHODS

FITBEN offers the following payment methods: Credit card (Visa, Visa Electron, Mastercard, Maestro), ATM and Cash on Delivery.

The payment made by bank transfer through the ATM network or your Homebanking, takes about 1-2 business days to enter our account.

The order will be sent only when we confirm receipt of your payment.

5 - CANCELLATION, RETURNS AND EXCHANGES

FITBEN only accepts returns of new products, complete and in the original packaging of the order, damaged, altered or streaked products and incomplete products will not be accepted, nor will any refund be made for the same conditions as mentioned above.

If the customer refuses and intends to retrieve the item, the customer must bear the costs of transportation. To exercise your right to return, contact our Customer Support with the reference number you wish to return and the reasons. The customer service is available from Monday to Friday, from 9 am to 6 pm.

Cancellation:
Once an order has been placed, the only way to cancel it is through Customer Support and it should be done as soon as possible, because once you have left our warehouse, the order cannot be canceled.

Orders / Products Returns:
FITBEN may choose how to collect the product through the carrier or through the commercial manager, it is the customer's obligation to keep the product in perfect condition until it is collected.

Collections are free if the reason for the return is the responsibility of FITBEN.

If the reason for the return is presented by the customer, the cost of collection will be deducted from the refund amount corresponding to € 5.00 + VAT.

Out of stock:
FITBEN will contact the customer to inform them that they can exchange the product for a similar product, in situations of out of stock. If the customer does not accept this possibility, a credit note will be made to the customer and a transfer will be made to the bank account designated by the customer.

6 - PRODUCT INFORMATION

The information made available on our website meets a correct presentation regarding the value of the products. However, we reserve the right to refuse orders where product information has been incorrectly published, including prices and promotions.

The refusal of orders can be related to other reasons, which are related to the discontinuity of a product, the inability to access the payment authorization or the possibility of fraudulent orders.

We warn you to be aware that we are not responsible for any loss you may suffer if a third party obtains unauthorized access to any data you have provided.

FITBEN may change prices without prior notice.

7 - PRODUCT WARRANTY

In the event of a defective product, FITBEN shall proceed, as appropriate, to repair, replace, lower the price or terminate the contract. This management should not incur any cost to the consumer and user.

FITBEN responds to non-conformities that appear within two years from the delivery of the article, with the exception of perishable products, in which we only guarantee that the products are delivered within the validity period and with a minimum of 30 days, with our responsibility ending after delivery due to the fact that we do not control how products are stored or stored. All non-compliance will be analyzed by our Customer Service.

This warranty is subject to electronic products or all those with a manufacturer's warranty.

FITBEN will provide after-sales assistance to consumers and users, in addition to after-sales service and commercial guarantees, as well as their conditions.
